7.2.1 DEATH OR PERSONAL INJURY AS A RESULT OF ANY NEGLIGENCE; AND
7.2.2 FRAUD OR FRAUDULENT STATEMENTS ON THE PART OF ITS DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS OR AGENTS.
7.3 WITHOUT PREJUDICE TO THE GENERALITY OF CLAUSE 7.2, YOU AGREE THAT Entec Polymers Inc. SHALL NOT BE LIABLE TO YOU FOR ANY LOSS OF PROFIT, LOSS OF REVENUE, LOSS OF ANTICIPATED SAVINGS, LOSS OR CORRUPTION OF DATA, LOSS OF CONTRACT OR OPPORTUNITY OR LOSS OF GOODWILL.
7.4 THE PARTIES AGREE THAT ALL STATUTORY WARRANTIES AND ANY OTHER WARRANTIES EITHER EXPRESSED OR IMPLIED ARE HEREBY EXCLUDED TO THE FULLEST EXTENT PERMISSIBLE BY LAW.

8 Indemnity
8.1 YOU AGREE TO INDEMNIFY AND HOLD Entec Polymers Inc. HARMLESS FROM ANY CLAIM OR DEMAND MADE BY ANY THIRD PARTY ARISING OUT OF YOUR USE OF THE Entec Polymers Inc. WEBSITE, YOUR USE OF ANY LINKS TO WEBSITES OPERATED BY THIRD PARTIES. YOU AGREE TO COOPERATE WITH Entec Polymers Inc. AND TO COMPLY WITH ITS REASONABLE INSTRUCTIONS TO LIMIT OR MINIMISE ANY LIABILITY OF Entec Polymers Inc..

9 General
9.1 You may not transfer or sub-licence this Agreement.
9.2 Entec Polymers Inc. may transfer this Agreement to any person taking over the supply of the Entec Polymers Inc. website or any part of the Entec Polymers Inc. website. Entec Polymers Inc. may also sub-contract the provision of the Entec Polymers Inc. website or any part of the Entec Polymers Inc. website to any other person.
9.3 If any part of these terms and conditions between the parties is found to be illegal or unenforceable, this will not affect the validity and enforceability of the remainder of the Terms and Conditions.
9.4 Any delay or failure by either party in enforcing any right under the Agreement is not a waiver of that right and will not prevent that right or any other right or remedy from being exercised or enforced.
9.5 Nothing in this contract is intended to confer any rights on any third parties by virtue of the Contracts (rights of Third Parties) Act.
9.6 The provision of the Services and the application of these terms and conditions are governed by English Law and subject to the exclusive jurisdiction of the English Courts.
